Jodi Arias Murder Trial – Day Fifty-Six

What a long, long day we had yesterday.  I can’t tell you how many times I asked, ‘what’s the point to all this?’ when Willmott was up! Then I was thinking I was having hearing issues or lost my comprehension skills!

We’ve come a long way on this journey and we are down to juror instructions and the closings.  Hopefully, the jury got some decent rest last night and is on top of their game this morning.  Pretty sure the jury will have the case first thing Monday, when they are fresh!

Oh, and I fully expect Nurmi will call for a mistrial, again!

Letting ya know now, I won’t be transcribing the jury instructions…long, tedious…no way, no how is it possible, but it does have to be put on record!  The biggie will be if manslaughter included!

Court open for business, late, at 10:11.

Stephens starts off by reading the instructions to the jury.

Count 1…first degree…intentional and premeditated.

Includes 2nd degree…intentional or caused death knowing life would be lost.  2nd degree does not require premeditation.

Unanimous jury decision for both.

They got manslaughter included and that is not really surprising!  This is what the defense was going for – self-defense theory was bogus from the get-go.

OMG!  Jodi was just yawning!

As much as I hate jury instructions, these are fairly well written, understandable.

Juan up…

Jodi stabbed him over-and-over again, slashed his throat, and shot him; she will not let Mr. Alexander rest in peace.  She has lied repeatedly and craves the limelight. She has gone to the media, wrote a manifesto in case she became famous.

She is manipulative.

Mr. Alexander even said she is destructive.

She attacked her mother.

She continues to lie about the gas cans.  She bought one, but returned one for cash.  You heard that Wal-Mart checked every register and there was no return.

Her manipulation goes back to Bobby Juarez.  She found out that Bobby was sending letters to another woman.  But, it wasn’t her fault the computers in the library didn’t have security enough to stop someone to hit the backspace button.

Then the same thing happened with Mr. Alexander’s computer.

The she went with Matt McCartney.  The same thing happens.

Then we see Darryl Brewer, he didn’t want to marry her, so she leaves him.

It’s a pattern, but none of this was her fault!

Love Juan does all this off the top of his head…no notes!

The Feb email never says thanks for the unholy underwear because they never were sent.  She lied.  She can’t prove it because she claims she destroyed them.

She read his text messages on his, but that wasn’t her fault!

Whoa, Juan just mentioned her “fake” tears on the stand!

Jodi has kept her head down doing her arts and crafts!

They broke up and what does she do?  She moves to Mesa and starts her stalking.

She was peeping in his windows at night.  Saw him kissing another woman.  So what?  He had every right to be seeing another woman.  He had moved on, they weren’t together anymore!

The physical violence?  Never happened.  There are not reports to police, no medical treatment, and no witnesses.  Nobody saw bruises.

The family is seething!

Juan effectively just trashed Alyce LaViolette testiphony again!

Turns out, Jodi told Dr. Karp in the beginning there were many, many incidents of domestic violence…on the stand, it became there were only 4 ‘supposed’ incidents.  She can’t remember whom she said what to!

Juan gets in that sex tape was for Jodi’s benefit.  Travis had no idea it would ever be made public.  Yet, Jodi saved it all that time.

Travis told people he was extremely afraid of Jodi and her stalking behavior on May 26th.

Juan shows Travis’ message to her that says, ‘ you are the worst thing that ever happened to me.”

May 28 she started the planning for killing Travis.  She stole her grandfather’s .25 gun.  In California, they take your name and there is a waiting period…easier to steal one.

The burglars went into to 4 rooms and only took one item from each room!

She didn’t want to be linked to AZ in anyway with her credit card, so she called Darryl Brewer to borrow gas cans and told him she was going to Mesa!

She rented a car for the trip…90 miles from home in Yreka so people wouldn’t recognize her!

Juan is so nailing premeditation…what a pro!

Jodi brought cd’s of their trips together from Yreka, loaded them into the rental, which gave her a reason to stop in at Travis’!  She thought far enough ahead about that as well as the check she left on Travis’ desk!  There is no proof that Mr. Alexander knew Jodi was coming!

Nurmi has made 2 bogus objections about Juan misstating evidence…ahhh, no he didn’t, big liar!

Juan’s sarcasm has been spot on!

Lunch recess called…

Court resumes at 1:35 with the ever-popular sidebar…

Juan is going through all of Jodi’s stories about why the cell phone was off while she was in AZ.  She did that so the police will never be able to find out.

She showed up at Mr. Alexander’s with a gun and a knife.

Whenever she got caught she says, ‘oh no, I was lying then’.  That is her fallback position.

She says she walked into Travis’ house and stood there and watched him for 30-35 seconds.  Who does that?  Isn’t that stalker?

She told Travis she was tired so the went to sleep without having sex.

She told Dr. Samuels the sex photo were taken while she was straddling Travis and she had seen all these photos of women’s breast on his computer.  Why would she do that?  To manipulate you again.

If Travis’ sexual behavior is bad because he was a Mormon, then hers was also because she was a Mormon also.  So, stop pointing or wagging the finger at him, she was there and participating willingly.

She claims Travis asked her to take photos of him in the shower because he had toned his body and was proud of it.  But, if you remember Darryl Brewer said she took photos of him in the shower one time.  He didn’t want her to.  So she was comfortable with this behavior.

Now into there was no rope in the bedroom…she made it up in order to explain the knife being there.

Shows Travis’ photo sitting in the shower, nude, defenseless and with no dignity!

She told you she shot him first.  But, look at the lies she told the experts, the police and told here.  Why would you choose to believe this one lie?

We know Mr. Alexander has defensive wounds on both hand, trying to grab the knife.  But, then she stabs him in the heart.

You knew he moved to the sink with blood pouring out of his mouth and nose.  Juan shows the photo of blood all over the sink area.

While he’s standing there, she is stabbing him in the back and the back of the head.  Juan puts up the photo.

Now photos of the hallway with blood transfer on the walls as he is stumbling down the hall trying to get away from her.  She chased him down.

He’s got the wound to his chest, his back, his head, but he’s still alive with life leaking out of him,

Juan shows the photo of Travis’ blood at the end of the hallway where she slit his throat.

It was a very well orchestrated kill.  If it was in the heat of passion it would have been random and all over.

She shot him after the heart wasn’t beating, he was dead.

She killed him 3 times over!

Men and woman alike sitting with the family are weeping!

Then she cleans up and deleted photographs, but only some of the images…only the ones that could hurt her!

There in no fog…her actions were deliberate, she was thinking!

The camera in the washing machine is significant because there were no bloody footprints down the stairs.

She washed Travis’ body to wipe away any of her DNA.

She staged the scene.

She did other things.

She remembered to put the license plate on the car.

She packed up her bloody clothing.

Grabbed her stuff and purse.

She filled the car with the gas ca.  If you’re in a fog, how could you do that?

Why did she leave a message on Travis’ phone after she killed him?  To manipulate you.

She continues and calls Ryan Burns saying she found her cell charger and continues to his hose in Utah.

Then she tells Leslie Udy, her kids and Travis’s kids will play together in the future.  Again, staging the scene.

Now she came into court and staged her defense by lying to you!

Juan is debunking the defense and their experts.  Points out AVL came into court and lied to them, omg!

Dr. Samuels lied about the scoring and rescoring the tests.  He gave the PDS test and there is no doubt the defendant lied.  How valid can his results be?  He admitted he probably should have re-administered it

Juan has been masterful!

Court back at 3:04.

The defendant’s lies to the police officers are important because they fit into her particular plan.

She was asked if she was there?  No, I wasn’t even there.

Well, wasn’t your fingerprint in the blood?  Of course, I was always there.  Shows how she can manipulate things to her story.

She kept asking to see the crime scene photos she could conform her story to the scene.

The she changed to the ninja story, making herself the hero!

Years go by and now we have the current story.

She lied to police, medical professionals, and the media.  All for her benefit to make her look good.

All her stories of acts of domestic violence are lies!

Then she made up the story about Travis being a pedophile.  How absolutely hateful!

There were no photos found on the computer or in the house.

Why didn’t she go to the police?  Because she took this story too far.

These lies, take from Mr. Alexander, what little he has left, his reputation!

The pedophilia allegation, it doesn’t get any higher or worse, however you want to look at it.

When it is to her benefit, she will lie!

The defendant is asking you to help her carry the gas cans.   Don’t leave the courtroom with the stench of gas on your hands.  Do not carry them for her!

What a day yesterday!  Juan Martinez really hit it out of the park.  He really tied things up and explained to the jury how simple it is for them to reach a guilty verdict!

Jodi is a manipulator and lies when it benefits her!

Court begins at 9:09.  Buckle-up, I think we’re in for a bumpy ride because Nurmi has asked to approach….grrr.

Nurmi….

Aspects of the human relationship play a prominent role…fear, love, sex, lies…

Nurmi shows the photo of Travis in the shower and then the one 3 minutes later with Travis’ body be dragged and asks what happened in those minutes.

Now playing on the fear of the jurors…they missed something…the other jurors may not like what you feel

Objection…approach…

You may feel fear how your verdict will be received by, Ms. Arias, the court, the world…

Put that fear aside and look at the evidence…

This is not about bad haircuts, the sexual orientation of the witnesses.

It’s not about whether you like or don’t like Jodi Arias.  Most days I don’t like Jodi Arias.

Jodi has a big smile for that one!

In May 2008 she moved back to Yreka to get away from Travis.  She journaled about how lightened she felt.

She began communicating with and dating other men.  She wasn’t stuck on Mr. Alexander.

Why would she stage the burglary at her grandparent’s house?  She could have just taken it and there would be no police report.  Or she could have gotten a gun from her father’s collection.

She rented a car.  Even the State admitted she was a smart woman.  Why would she leave a paper trail?  You wouldn’t do that if you’re on a covert mission!

Gotta say, not impressed… not a single argument has been persuasive!

Says when Darryl Brewer testified she came to borrow gas cans because she was going to Mesa that he was probably mistaken when he said Mesa!

Swear, if Nurmi says ‘covert mission’ one more time, I’ll reach through the screen and bitch slap him.

Is Jodi guilty of lying?  Yes, she is, but your not being asked to convict of lying…it’s not on the verdict form and we’ll get to others who have lied in this case later!

Oh, that was a hell of a threat Nurmi!

Nurmi already up to June 3rd!

LMAO off…Juan isn’t even taking notes, bet the jury isn’t either!

Lots and lots of bullshittery happening here!

Nurmi asks if she had the gun and knife when she got to Travis’ house, like the pros says, why didn’t she shoot him then and there?

Showing picture of Travis in shower with his back to Jodi in arguing he would not do that if he was scared.  Also said with his back to her, that would have been her perfect opportunity to kill.  He wouldn’t have even seen her coming!

IMHO, Nurmi’s closing is only bolstering how weak the defense case is…smoke and mirrors!

Now shows photo of Travis sitting in the shower…when the pros says he is naked, we concede that.  They say he is vulnerable, is he?

Jodi gets down and strikes with the knife?  What didn’t she just shoot?

Now onto Jodi’s self-defense claim…

Nurmi conveniently forgets Jodi is mentally disturbed. You could tell that from her 18 days on the witness stand!  Nothing he’s saying makes sense the way Nurmi would like the jury to believe!

Jodi was assaulted on 4 different occasions as you’ve heard.

Slapping her, kicking her, breaking her finger…

Oh, sexual assault and penis talk…here he goes!  Going over the whole list.

Nurmi is so misstating things said by the State and their witness.

Now he’s moved on…trashing Travis and interest in little children!

Twice he’s bashed Deanna Reid and her character!

Nurmi is going all over the board now, jumping from one thing to another!

Everything Nurmi is presenting is based on nothing but Jodi’s lies!

Nurmi is really attacking Travis Alexander’s character…could backfire on him if the jury has sympathy for him.

The only positive about this is, it is the LAST time anyone will bash Travis Alexander’s character!

Oh, Travis made-up the stalker idea just in case he caught her sneaking in or out of the house!!!!

Notice I’m not reporting on the bullshittery???  He’s presenting Jodi’s lies and skipping over forensic facts.  I’m beyond disgusted!

OMG!  Claims Dr. Horn said the bullet never entered the brain!  Absolute lie!

Now attacking Det. Flores.  Nurmi said that Dr. Horn should be sitting next to him so the light of truth could shine on both of them!  Somebody is lying here…not Jodi Arias!

Noon recess called…limited to 1 hour today!  (yeah, sure, lol!)

Court resumes at 1:00!!!  On time, but of course the inevitable sidebar…

Jury back at 1:03.

Nurmi is really trying to get at least one juror to go for doubt and there was no premeditation.  Pointing out manslaughter in the juror instructions.  The defense and Arias, as well, know the have no case.

Was Jodi a reasonable person when she dragged Travis’ body 10 feet down the hallway and shoved him in the shower?  Was she reasonable when she had already stabbed him in the chest, think it was ok to continue stabbing him in the back and his head?

I freakin knew it…Nurmi playing cherry-picked pieces of the phone sex tape…pig!

If this was just for shock value, I might understand, but Nurmi gets off on this salacious garbage.  There aren’t enough barf bags in the warehouse!

Jodi was Travis’ dirty little secret.  Travis was free to date good Mormon girls because he used Jodi for the sex.

I am so skeeved out by Nurmi!!!  In my mind’s eye, I see him in a wrinkled, old raincoat, slouched down in a seat at a porno movie.

Nurmi is rambling and all over the place…I’m ready to nap!  He’s just making stuff up about the crime scene.

Dr. Horn said Travis wouldn’t have been able to move, but here you see Travis is holding his head up and his arm is up.

Good gawd, she was dragging him…his head was against her leg and she was pulling him after grabbing him under his arms!!!!!

So, anyone hear Nurmi explain the defense version of events, explaining all the stab wounds????

Ahhh, ALV said abused women don’t know where to stop.

She snapped after all that had happened.  Heat of passion after the toxic relationship.

She very well may have snapped!

The ultimate question is what happened in that moment in time.

Uhhhh, Mr. Nurmi, excuse me…I think many have a gun and knife on them now!

If Ms. Arias is guilty of anything at all…it’s manslaughter!

Everything presented to you was argument so you could not focus in on this case!

The salacious tape that was played didn’t contain any of Jodi’s words, only Mr. Alexander’s.

Juan is incredible…my heart be still…he is so championing the character of Travis’ and his memory and justice for his family!

They talked about booty call. Travis’ was Jodi’s booty call!!!

Everything has been argument.  Where do you draw the line?  She has lied to everyone and came in here and lied again!

First-degree murder is the true and correct charge here!

Ms. Arias couldn’t let Mr. Alexander go!

You now have the burden of reviewing the facts and I ask you come back with a verdict of guilty because Travis was slaughtered by this woman.

And, the master prosecutor is done!!!

I will go to sleep tonight knowing the forensics and the prosecution proved 1st degree is beyond a reasonable doubt to me, Arias committed the heinous, vicious crime. 

It’s been a long time coming for Travis, his family, and all of us searching for justice!

Been a long, painful haul, but we have a verdict!

It ain’t over yet because most likely we will go into the penalty phase.

Aggravators will include whether or not this was a heinous crime.

Ya think?

Murder 2 has an aggravation phase and the judge sentences 4-6 weeks later.  10-25 years, would walk in 5-7 years.

Voluntary Manslaughter:  30-60 days judge sentences to 7-20 years.

Ex-jurors 5, 8, and 11 are seated in court!

Per Jamie Satterfield, Knox Sentinel reporter, “it kind of sucks that the tv media already announced it will be in Nashville.” yeah they are violating Judge’s order!

It was a win-win yesterday.  Travis, family and friends got their 1st degree murder verdict.  Juan Martinez and Esteban Flores proved their case!

Juan only need put Dr. Horn on the stand.

In one of her infamous TV interviews, Jodi claimed she would rather a death sentence than life in prison.  She repeated that last evening on Fox10.

So, if Jodi really feels that way, she will direct her defense not to put on a mitigation case.  Or is she such a maniac she will again take the stand and plead for mercy?

Will be interesting!

No court today. Reconvene May 15th at 10am.

Beth Karas suggested Jodi is getting evaluated…defense doing an end-run.

Holy crap, she’s still running the show!

Christian/Newsom Murders – George Thomas Retrail Begins

22231650_SSThe retrial of George Thomas begins this morning.

Senior Judge Walter Kurtz will preside.

Defense includes Tom Dillard and Stephen Ross Johnson.

Prosecutors are TaKisha Fitzgerald and Leland Price.

The jury, seated Friday, comes from Nashville and will be sequestered in Knoxville.  The jury consists of eight women and eight men. Five of the women are black. All of the men are white.

Thomas was first tried in 2009 and sentenced to life in prison without parole for his part in the carjack, kidnap, rapes and murders of Channon Christian and Chris Newsom.images-2

If found guilty again, the jury will decide whether Thomas should be sentenced to a life term with the possibility of parole after 51 years or with no chance of parole.

Because of double jeopardy, the prosecution cannot seek the death penalty, but they are seeking life with no parole.

Unfortunately for the families and many of us, this will be the sixth painful trial.

Eerie hearing all 48 charges again!  Must be so difficult for the families. Gary is doing his angry rocking in his seat.

TaKisha Fitzgerald is presenting opening statements.

She shows a diagram of the Chipman Street house to the jury.

Jan. 6, 2007 George Thomas, Lemaricus Davidson, and Letalvis Cobbins carjacked Channon’s SUV and kidnap she and Chris.

She details how Chris’ body was found on the train tracks, shot, and burned.  Chris had also been raped.

When the kids didn’t come home, the families went out searching and found Channon’s SUV.  All her belongings were missing.

Police entered the Chipman Street house and Channon’s badly beaten body was found stuffed in a garbage can.  She had been orally, vaginally, and anally raped.  Davidson and Cobbins’ DNA were found.  Thomas’ DNA was not found.

Thomas did ride around in Channon’s SUV.  He did nothing to stop any of the brutality.

Stephen Johnson for the defense.

Johnson says George Thomas is not guilty or criminally responsible.  Being present is not a crime.  Failing to act to stop a crime is not a crime.  It’s not murder.  It’s not rape.

Thomas never participated in any conversation to steal a car.

Thomas’ DNA and prints were not found.

Thomas sat in a corner of the living room, smoking dope and watching television.

Why didn’t he help?  He grew up in Detroit Michigan.  He knew to survive, to keep his head down.

He did tell Davidson not to steal the car and to chill.

Thomas was asleep and woke when Davidson, Cobbins, and Eric Boyd came back in the house with Channon and Chris.  He decided he wanted no part of this and wanted to leave.  Boyd and Davidson, who had guns, told him he wasn’t going anywhere.

Wow, Kurtz just said he wants to go to 6pm!

Johnson continues…

Thomas’ police statement says he was trying not all to get involved.

The statement attributed to Thomas, F*** that white girl, she means nothing to me, wasn’t recorded.  It’s up to you to decide if it was made.

State calls Josh Anderson.  Good friend of Chris Newsom.  He also knew Channon.  He played golf with Chris the day he was kidnapped.

They were all going to a party at Jamie Hampton’s house that evening.

Chris and Channon never showed up.  At 10pm they tried to contact on their cell phones.

He and another friend drove to Kara’s apartment where Chris and Channon were supposed to be, but they weren’t there.  Chris’ truck was in the parking lot, but Channon’s SUV wasn’t there.

The next morning they started discussing where Channon and Chris might be and then found out Channon didn’t show up for work.

That evening he and a bunch of friends went with the Channon’s family to go out and search for Channon’s vehicle.

They found Channon’s SUV at Chipman and noticed all the stickers had been taken off the SUV.  They called police.

He identifies photos of Channon’s SUV.

The front seats were pushed all the back.  The back seat had mud and a pack of Newport cigarettes.  Neither Channon nor Chris smoked.

He identifies Chris’ baseball cap and sneakers he wore that day.

Kara Sowards called.  Channon’s best friend and it was her apartment that Channon and Chris were at.

Chris was going to pick Channon up to get something to eat so Kara left to go to the party saying she would see them in a little bit.

She got home around 3:30 am and she saw Chris’ truck, but Channon’s SUV wasn’t there which was strange because Chris also drove.

She also went searching for Channon Sunday night.

Kara identifies photos of Channon’s 4 Runner and her apartment complex.

Kara identifies the clothing Channon was wearing the night of Jan.6.  A pair of jeans, a white camisole, pink stripped sweater, and hot pink heels.  Photos that Channon kept above her visor.  Channon’s purse.  Channon’s iPod   Some of the cloths bagged to go to Goodwill that were in the back of the SUV.

This is the first trial where Kara hasn’t burst into tears while on the stand!

Xavier Jenkins called.  He worked at Waste Connection, across the street from the Chipman Street house.  He saw Channon’s SUV at the house.

The SUV pulled around and checked him out and saw 4 people in it.  He believed they were 4 black males.

The mean mugged him so he mean mugged them back because he had the right to be there.

He saw the stickers on the back window of Channon’s SUV.

Told his supervisor something was wrong…the SUV was out place in that neighborhood.

Jerome Arnold called.  He lived a block from the Chipman street house.

He was watching television and at 1:45 Sunday morning and heard 3 large pops.

Roy Thurman called.  He was working off of Cherry Street and saw smoke coming from the railroad tracks.

He found out later that a body had been found on the tracks and told police what he saw.

Jay Ford called.  Railroad engineer.  He found Chris’ body on the tracks.

At first he thought it was a log originally.

He stopped the train and called the dispatcher and told him what he saw.  Walked back and saw a badly burned, naked man.

He waited for Det. Childress and other LE to arrive.

He identifies a photo of the burned body of Chris.

He saw the body between 12:15 and 12:23.

Robert Watson called. TN Fire Marshall bomb and arson unit.  Then became a K-9 handler.

He collected evidence from the tracks.  The ground showed definite evidence of gasoline.

He identifies photos of the scene.

Russ Whitfield, Knoxville City Police, forensics.

Jan.10 he went to the railroad tracks and photographed they evidence LE was collecting.

At a creek about 50 yards away he found multi-colored cloth he saw on the tracks and also a blue dog leash.

Laura Hodge called.  TBI crime lab.  Fire debris and gunshot residue analysis.

She reviewed the cloth and dog leash for ignitable liquids and found gasoline on both.

Kileen Wigel called.  She lived a short distance from Chipman.  Police came and asked about a vehicle parked in front of the house at 1:45am.  The 4 Runner. She was on her porch at midnight and there was no vehicle there.

Dan Crenshaw’s testimony is being read.  He passed away last year.  Forensics fingerprints, Knoxville Police.

Crenshaw was the one who found Davidson’s print on the bank envelope found in Channon’s SUV which lead to the Chipman Street house!  Davidson had been arrested prior and his prints were in AFIS.  The print was identified and a second person verified the print.

The vehicle was very clean and had been wiped down.

He also examined the trash bags that Channon’s body was stuffed in. He looked at 5 bags she was stuffed in and founds prints on the outer 3 bags.  He identified prints from Lemaricus Davidson’s palm.

He also found prints on Channon’s pay stub and photos from Channon’s SUV.

George Thomas’ prints were not found.

Keith DeBow called.  Knoxville Police.  SWAT Team.  He responded to Chipman.

They entered and cleared the residence.

The house was empty and when he saw the misshapen trash can in the kitchen and found Channon’s body in the trashcan.

The only door in the house was an accordion door to the bathroom.  No other doors, just blankets over the doorways.

A few days later he was called to the abandoned house where Davidson was hiding out in.  The broke a window out and got Davidson out.

Spent 22 caliber cartridges. cases are seen in the sunroom and they go through room by room.

Several live 22 caliber rounds were also in the house.  A rifle was also found in the bedroom closet.

Tim Schade is called.  Knoxville PD forensics. He verified the fingerprints identified by Dan Crenshaw.  Lemaricus Davidson prints.

He details how prints are lifted and what types of surfaces that can yield prints.

He also found detail on the gun magazines found at the house.  Davidson and Cobbins prints were found.

Thomas’ prints were not found.

All of this testimony is being brought in to show just how heinous these crimes where and Thomas just sat back and heard it and let it all go down without a care in the world!

Jury brought in.

Mary Newsom is testifying to what happened that day and said when Deena Christian called and said Channon hadn’t shown up for work and they got really scared.

They tried calling Chris’ cell, but got no answer.

They stayed up all night.  Police came by to get DNA for Chris.

On Monday police came and told them they had found Chris’ body.  They were devastated.

Mary identifies Chris’ sneakers, his baseball cap, his wallet, his belt that is badly burned.

Deena Christian takes the stand.

Deena talks about Channon’s education.  Dating Chris.

Channon had a cell phone and her 4 Runner.

TaKisha asks Deena about the day of January 6.

She helped Channon pick out what she was going to wear to Jamie’s party that night.  Channon packed the clothes in a bag to take over to Kara’s apartment.

Deena knew Channon intended sleep over at Kara’s.

Channon called home around 12:35 and said plans had changed and she was coming home, but Channon never showed up.

Deena called Channon’s cell numerous times Sunday morning, but it went to voice mail.

Around 3pm Channon’s boss called and said she never showed up for work.

They called the hospitals and the jail, but nobody knew of Channon.

The police told her they weren’t going to look for Channon and to look by themselves.

She called the Newsoms’ and then they went driving looking for Channon.  Deena had been able to get the last ping for Channon cell so the knew to look in the Cheery Street tower area.

When the vehicle was found, Deena drove over and gave the police the keys to Channon’s SUV.  The car stickers and license plate were missing.  The car was cleaned out and the front seats were pushed all the way.

TaKisha shows photos of Channon’s vehicle that Deena identified.  Now photos of items of clothing taken from Chipman.  Deena also identifies jewelry and other personal items.

TaKisha now showing clothing that Channon packed to go to the party.  Deena identifies all of them.

State calls Linda Littlejohn.  TBI Crime Lab Microanalysis.  Shoe prints and fiber analysis expert.

Littlejohn analyzed the floral and pink fabric from the crime scenes and autopsies.

She identified the pieces of fabric and says they came from what appears to be curtain and be set.

Davidson ripped up a sheet and curtains and those strips were used to bind Channon and Chris.

Taylor Shadix called.  Knows Daphne Sutton, Kayla Trout, Cassie Suttles all worked together at Sonic.

She knew Lemaricus Davidson because he was dating Daphne.  Identifies a photo of him.

Says Daphne and Davidson lived together at Chipman Street.

Daphne moved out in December.  She stayed at Cassie’s and her parents.

Davidson was calling her looking for Daphne on Jan. 7.  She called Daphne and let her know ‘Slim” was looking for her.

Davidson showed up at her house and asked to stay over, she said no.

Davidson showed up and she gave him a ride to where Daphne was.

Daphne Sutton called.  She dated Davidson starting Sept. 2006.

She and Davidson rented the house on Chipman Street.

They started arguing and he got physical so she left around Thanksgiving.  She came back in December and the trouble began again.

She met Letalvis, George, Stacy, and Blue from Lebanon, KY because they came to stay at Chipman.

She moved all the furniture from the house.

Did you meet Vanessa Coleman?  Yes.

Friday, Jan 5 they got into a fight and Davidson choked her and threw her against the wall.  Nobody did anything to help her.

She left and called Cassie to pick her up and she stayed there.

Sunday, Lemaricus called looking for her.

She went to Chipman because she thought Davidson had a girl in the house. She noticed Davidson had a blanket over the bedroom door that had never been there.

She tried to get to the bathroom to get her makeup.  Davidson wouldn’t let her and said Vanessa was in there.

She saw Letalvis and George sitting in the house.

Davidson gave her a bag of clothes and she left back to Cassie.  She started going through the clothes.  She saw a red skirt and the clothes weren’t new.  She called and asked him about them and he said he thought she would like them.

Twice, Davidson showed up and was driving the 4 Runner.

She gave Davidson the clothes back,

The last call she had with him was when she went to pick him up.  He had shoes on that looked too small and she had never seen them before.

Chris’ sneakers!

They drove to where Davidson’s friend Vince left money to buy drugs.

They all stayed at Cassie’s.

On Tuesday she found out from her mother a dead female was found in the Chipman Street house.  She told him he had to leave.  She picked up his jacket and found his keys and a gun.

They drove him to a place near the park.

TaKisha shows her the sneakers and the red skirt that she identifies.

She identifies Davidson’s gun.

Her neighbor, Rhonda, introduced Ethel Lynn Freeman to them.  Ethel would buy drug from Davidson.

They helped Ethel move and she gave Daphne a bedroom set and some pink curtains that Daphne identifies.

She identifies the garbage can Channon was found in.

TaKisha is showing a video of the Chipman Street house.  Daphne points out the gas can was out of place.  She doesn’t recall the gun sings being there.  Says there was never in the bathroom.

Says the garbage can was never kept in the kitchen, it was kept in the back room.

12:25 Lunch called….

Cassie Suttles on the stand.  She remembers going to Chipman Street to pick up some of Daphne’s things.  Daphne went into the house and was there for maybe 10 minutes and she came out carrying a sears bag.

Sunday Davidson called and later showed up in the 4 Runner.

Monday Davidson showed up and said his brother had his keys and he was locked out.  He spent the night.

The next day is when Daphne’s mother called about the woman’s body found at Chipman.

They gave Davidson a ride to a park.

State calls Gerald Smith.  KPD.  He was with the forensic unit and documented with photography and collected crime scene evidence.

Jan. 11 he was called to Reynolds Street.  This was a vacant house where Davidson was hiding out in.  Smith documented the items Davidson had in the house.

He identifies photos he took that day.

He identifies the gun found at the house.  And Chris’s sneakers found at the house.

Patricia Resig is called. KPD firearm examiner.

She examined the two guns.  The 22 was test fired and it functioned properly.

Another 22 was received with the cylinder separate.  Test firing showed it to misfire at times.

She identifies 5 fired cartridges that came from the 22 she examined.

She identifies several more fired cartridges that were removed from Chris’ body.

One of the bullets was too damaged to say it was fired by the same gun.

She also visited the Chipman Street house and took measurements of all the rooms.  The entire house was approximately 805 square feet.

Using rope, she marks off the dimensions of the house inside the courtroom.  It doesn’t even take up the whole court.  Very, very tiny house…no way you could miss what was going on in that house particularly because there where no interior doors!

Were the cartridges tested for fingerprints?  I don’t know.

He received a white tank top to determine what caused the stains.  He tested the areas and found there was bleach on the shirt.

He identifies a copy of his report, as well as the white shirt.

State calls Jody Long.  She knew Vince Wornamock.  She used to buy drugs from him.

He asked her to take some people to Kentucky. He gave her gas money and drugs in payment.

She picked up Cobbins, Coleman, and Thomas.

She’s sketchy on details because she was a heavy druggie.

There wasn’t a whole lot of conversation in the car.

She drove about four hours to get to Lebanon and drop them off.  They unloaded stuff and took it into a white house.

She turned around and drove back to Vince’s.

She identifies Thomas as one of the people she drove.

Jan 10 he was advised of what had happened and he was sent from Knoxville to Kentucky that night.

Jan 11 ATF and other LE met with the Lebanon PD to discuss what they were going to do.

They found Stacy Lawson and took he to the police department.  They then went to Natosha ‘Blue’ Hayes house.  They surrounded the house and announced over speaker for all of them to come out.

Natosha and Vanessa came out and the Cobbins came out with his hands up.

Thomas refused to come out.  He finally did come out and was arrested and take to the police department.

Waggoner helped secure the house and then went to the police department.

He watched Coleman, Hayes, and Thomas while they waited in the hallway.

All the suspects were interviewed.

He later went back to Hayes’ house and searched the residence.

He identifies photos of the house.

Photo shown of the red purse belonging to Vanessa.  The contents contain a bunch of Channon’s stuff.

He also picked a 22 caliber gun found in Kentucky in a box under the bed.  Natosha said she found it on the 12th while cleaning.  It was turned over to KDP.

It is believed Vanessa stashed it there.

He also searched the Chipman Street house.

He knew KPD had searched the house a few days earlier.

He identified the bleach bottle found at the Chipman house.

While in the house, he found what appeared to be a 22 caliber bullet hole in the living room wall and a larger caliber bullet hole in the living room ceiling.

Jan 7 there is a call at 4:05 am and it is a voicemail call. A call at 12:33 am also.

His testimony basically explains the whole cell phone pinging routine.  As boring as it is, it is how they found Channon.

The records are for Lemaricus Davidson.

Several outbound calls were placed on Jan 7 and 8th and a few incoming calls are detailed. This activity was with Daphne Sutton.

Stacy Lawson is called.  She drove Thomas, Cobbins, and Coleman to Chipman from Lebanon, KY.  She was George Thomas’ girlfriend.

She dated Thomas for about a year.

They stayed at Chipman Street in the beginning of December 2006 overnight.

The second time she went to Knoxville was December 14, they stayed for 3 days.

On that trip, they all helped move Ethel Freeman.

Lawson says the Chipman Street was so tiny that you could hear everything that was going on in the house and there were no doors in the house.

December 28 she drove Thomas, Cobbins, and Coleman to Chipman from Lebanon, KY.

On New Years Eve, they went outside at midnight and shot off guns.  She shot Lemaricus’ black revolver.  Cobbins owned the silver revolver.  She never saw Thomas shoot a gun.

She and Davidson got into argument and Davidson pointed the assault rifle in her face.  It upset her enough she decided to go home.  She asked Thomas, Cobbins and Coleman to go home with her.  They all said they wanted to stay.  Lawson left for Kentucky Jan 2.

Lawson placed Daphne at the house on Jan 2.  She tried calling Thomas.  Her cell phone was cut off on Jan 4.

She spoke to Thomas on the 10th and he was back in Lebanon and staying at Natosha’s with Cobbins and Coleman.  She went over and said they all looked like they were scared.  Thomas wouldn’t tell her anything.

Thomas, Cobbins, and Natosha were watching the Knoxville New online and she saw Davidson and Cobbins were shown as suspects.

She asked Thomas what happened and he wouldn’t say anything.

On the 11th police questioned her about the whereabouts of Thomas, Cobbins, and Coleman.  She originally lied and said she didn’t know, but quickly changed her mind and told them they were at Natosha’s house.

She identifies photos of the house on Chipman and Natosha’s house.

She said one night she and Thomas were sitting in the kitchen and Thomas had some coins and bullets on the table.  She asked what they were for and he didn’t say anything.

The next day, Jan 11, the police showed up and took all of them into custody.

Darin Williams called.  He knew Davidson because he bought cocaine from him

January 2007 he went to Chipman to buy dope.  Heard a car horn honking but didn’t recognize the cat.  When he stopped at the house, Davidson drove up in the 4 Runner.  He believes there were 4 persons in the vehicle.

He saw Thomas at Davidson’s house, but never spoke to him.

He saw Davidson several times at the house, but Davidson always came out.  One of the times, he saw the 4 Runner parked in the gravel lot across the street.

Nevil Norman called.  Knox County Sheriff’s Department homicide detective.

He took the missing person’s report.

Jan 11, he went to Lebanon to help arrest the murder suspects.

He and another officer covered the back of the house.

He and two others took statements from George Thomas.  The interview was recorded.

He identifies the Rights Waiver Thomas signed and identifies Thomas sitting in court.

Price plays the audio of the interview and the transcript is passed out to the jury.

The audio is really poor quality and pretty much not understandable.  Don’t know what the recording sounds like in court, but good thing the jury has transcripts to follow along!

He’s talking about the 4 Runner and that a blindfolded white girl and white girl being there.

This audio is awful…can’t follow it at all!  Have to remember how many years ago this happened and recording technology wasn’t as state-of-the-art as it is today!

I realize many are confused, but because this is a retrial, I believe the State has to present their original case…no additions; no deletions. Which is why you are hearing things that probably don’t make a whole lot of sense to you if new to the trial!

Court resumes at 1:32 …discussion about jurors taking notes on the transcripts and whether or not the can keep them…both sides agree.

1:37 cross resumes Norman retaking the stand.

After the interview, Norman asked Thomas why he didn’t do anything to help Channon and Thomas said, ‘f**k that white girl, she didn’t mean anything to me.’  You cops come into our neighborhood and kill us so why should I care.’

He didn’t report it till a year later because it wasn’t recoded.  He put it in a report later.

Three of you were hurling questions at him?  Yes.

Mr. Thomas told you he smoked a lot of weed?  Yes.

He told you he wasn’t paying attention?  Yes.

He said  ‘oh man, man, what are you doing?’

I went to the back room and wasn’t paying attention?  Yes, that’s what he said.

Cobbins said Davidson was gonna do something crazy?  Yes.

Jack a car and I just said chill out?  Yes.

That’s when he said he didn’t want to be a part of this and that’s when he and Cobbins, and Vanessa left?  That’s what he said.

Davidson tells cops “E”, (Boyd) and Davidson wouldn’t let them leave, even though they wanted to.  That’s what he said.

Defense cherry-picking the Thomas interview statements!!!!

Fair to say you were upset for George Thomas wasn’t doing anything to help?  No, that’s wrong.

Kayla Trout called.  She knew Daphne and stayed at Chipman off-and-on  when she had no place to stay.

Jan 7 she recalls several calls from Davidson’s cell phone.

She called Daphne to let her know Davidson was looking for her.

Defense arguing letters between Thomas and Cobbins, twenty and thirty, should not be introduce.

Letters are from ’08 and State argues there are 3 letters that show Thomas and Cobbins were close friends after the criminal events and defense says they are not probative.  They fact, they are signed love!

Judge Kurtz rules he will state a stipulation on the salutations and sign-off on the letters…they are fairly beyond friendly!

Jodi Arias Murder Trial – Penalty Phase Begins

What a trial nightmare!  Arias, Christian/Newsom and OJ all at the same time!  I’m tied up with Christian/Newsom, no time for OJ…will watch video later and my bestest buddy in crime graciously picked-up the slack for me in the Arias case.

The following entry is from ritanita, and very much appreciated!  Go ritanita!!!

Last time we saw Jodi in court, she was busy receiving her 1st degree murder verdict.  Since then, she’s been a regular whirlwind.

Let’s see, she gave an interview to her fave reporter, was shipped off to the psych ward for suicide watch, and is now housed in her home base, the Estrella jail.  She’s in a little cell in a new pod with the worst of the worst Estrella has to offer.  Shackles and belly chains are the order of the day.  I wonder if she’s missing her old buddies from the regular pod?

Meanwhile, she and her attorneys have had a couple of closed hearings with Judge Stephens.  Two members of the Alexander family attended a hearing along with Martinez and Flores as well.

Judge Stevens has put the kibosh on any future media interviews for the time being.

The mystery today will be whether she goes through the aggravation phase or decides to cop a plea to LWOP.  Oh, the drama!

Today, the court session only starts a little late.  Judge Stephens takes the bench at 1:10, EDT.  The jury is asked if they broke the rules.  There are no hands and the judge swears in a bailiff to protect the jury during deliberations.
The bailiff hands out instructions to the jury and the judge reads them aloud.  The instructions explain that they will decide if there is an aggravating factor which will send them into deliberations for life/death.  The jury can use all testimony and evidence already presented in the trial.  At this phase, they are not to consider the punishment.  Otherwise, the instructions are pretty much the same as for guilt phase deliberations.
Well, so much for a plea deal…
Juan Martinez begins his case by making his opening statement.
She made sure that she killed him by stabbing him over, and over, and over again by stabbing him before she shot him.  Travis felt extreme pain.  He was able to see, he was able to hear…

Juan mentions her faux suicide attempt…

She obtained a razor blade and cut her wrist and decided not to go forward because it “stung,” it “hurt.”  Travis Alexander suffered.
Objection… overruled.
Every time the blade went into his body it hurt, he was sitting in the shower and there were photographs being taken.  You see the lower quadrant of his body.  She took the knife and struck him three times in the chest while he was sitting down.  It was painful.  He suffered excruciating pain.  One hit him in his heart.  It cut the vein, it was just like a heart attack.
He was extremely afraid (objection… overruled).
DeMarte and Samuels discussed the fight or flight symptoms.  In this case, the person who was presented with these choices had to make a choice.  He could fight, or run.   He tries to reach up to take the knife away from her, his left hand…
Objection… side bar.
Ryan Burns said she was strong, he cut his hand as he sat there and grabbed the blade.  His right hand also gets cut.  After this, he gets up and goes to the sink.  He’s already hurting.  He has blood coming from his hands and chest.
He’s able to see the blood:  mental anguish and terrible pain.  He sees himself in the mirror (objection overruled).  He’s not only seeing himself, he’s able to see her (objection… side bar).  He saw her stabbing him in the head and the back and decides to flee.
He goes down the hall and finally made his rainbow in blood.  The last thing that Mr. Alexander felt was this knife, this woman, this blade coming towards him.  It was only death that relieved that pain and terror, and that is especially cruel.
Nurmi gets up to speak and says that they have to consider this was a cruel crime.  However, the question is not one of cruelty, we can all agree it was cruel.
Objection… sidebar
All premeditated murders are cruel.  The question is if it meets the definition of especially cruel.
The crime took place in 62 seconds.
There are 2 issues:  one is the pain Mr. Alexander suffered and did Miss Arias know that she was causing this.
The testimony of the specialists discussed the synapses in the brain, the perception of how the brains of both of them were working at this moment (fight or flight)  the State has not proven it’s case on this matter.
Is he trying to say that the convicted murderer was in a fog so she didn’t know she was being expecially cruel?
Martinez calls Dr. Kevin Horn, ME to the stand.
Sheesh!  Nurmi asks to approach!  Judge Stephens calls for a 10 minute break.
When the break is over, Martinez questions Dr. Horn.
What is it in the body that causes it to feel pain?  Damage to the nerve endings.
Exhibit 185 shows various wounds.  One of them pierced the heart.
What would it feel like to be stabbed in the heart?  Shortness of breath, pain, similar to a heart attack because the same nerve endings are being stimulated.
Exhibit 188: deep wound across the belly.  There are nerve endings there.
Exhibit 193: multiple stab wounds to upper back.  Impact the rib and spine.  There are nerve endings being severed and there is pain.
Exhibit 202:  goes into the deep muscle of the neck and impacts on spine.
Exhibit 200: A similar wound to the neck.  First one is deeper.  The first wound would be more painful as more nerves are severed.
Exhibit 185: (back of head)  There are nerve endings here.  Both impact the skull and there are divots in the skull.
Exhibit 182, Exhibit 180: (left hand)  They are defensive wounds.
Exhibit 170: (right hand) It is also wounded.
I miss the next number.  It is the neck wound.  There could have been more than one wound or decomposition that caused an irregular edge at the lower part of the wound.  Dr. Horn describes in detail the areas that were cut through.  When Dr. Horn is asked if Travis could have made noise after the wind pipe was cut through, Willmot objects and there is a bench conference.  The judge then sends the jury into the hall for a 2 minute recess.
This is excruciating for those watching.  There are tearful faces and looks of horror.  Many people in the gallery are looking down.  Jodi does her Cousin It imitation and dabs at her nose from time to time with a tissue.
Martinez’ final question was if Travis was alive when his throat was cut.  Horn answers yes.
Willmott gets up to cross.  She asked if Travis would have died quickly after the slash to the throat and Horn said he did.  He believes the gunshot was last.
The stab wound to the heart was fatal, but not as quick as the cut to the throat.
She gets him to say that the heart would beat faster and the blood would come out faster from the vena cava.
She brings up adrenalin.  It will rush through the head.  If Mr. Alexander is fearful, he is going to have adrenalin pumping.  She asks if adrenalin will cause a person not to feel pain.
Martinez objects… side bar.
Remember, Jennifer is asking leading questions and Dr. Horn is answering yes or no…  so far yes.
She goes back to the adrenalin caused by fight or flight and endorphins.   It’s a protective mode for our bodies to help us fight and focus on surviving.
Adrenalin will help a person’s heart pump faster, making it more rapidly fatal.
And, she’s finished.
Juan reminds us through Dr. Horn that Travis was alive when all the stabbing injuries occurred.  Even though the adrenalin is flowing people
can breathe and hear, assuming they are conscious.
Willmott objects and we go yet again to the bar at the side of the bench!
Martinez asks whether or not he was alive (shows picture of sink) at the sink.  Horn says he would have to be alive to stand and bleed at the sink.
If the individual is alive and can be standing at the sink and they are alive they can see and hear.  If he was alive at the sink and ends up at the hallway, and there is no evidence he was moved there, he can see, hear, breathe, think… and so on.
Just because adrenalin is present the nerve ending don’t go dead.  They can still feel.  Even with adrenalin being pumped through the system, the area of the heart would be in pain and could  be felt.
Dr. Horn explains that the irregular lower edge of the wound could mean overlapping cuts.
There is a juror question.  No, two.
Did you testify before that Mr. Alexander had three fatal wounds?  Yes, heart, throat, gun shot wound taken in isolation.
As to the throat, which is more likely, decomposition or multiple cuts?  Due to decomposition, he can’t say.
Martinez has him repeat the answer to the first question.  Then, he asks how long it would take for Travis to die from chest wound.  Horn answers that the wound was small and could take a few minutes, maybe more.  The wound to the throat would kill in a few seconds.  If it were the first injury, he would not be able to ambulate.  As for the gunshot wound, it would be fatal without medical attention.  The person would lapse into unconsciousness in a few seconds.
Willmott is up again to discuss the wounds.  It would take a few minutes for a person to die.  The person would die faster if he were moving around.
The defense closes it’s case.
We then go to closing arguments.
Martinez says that Ms. Arias made sure that he “did not go gently into that good night.”  She made sure he was nude, with a knife, in his own home.  It was where he felt sadness and joy.  The bathroom had a shower and she attacked him when he was in a vulnerable position.  When he was standing, he was totally unaware of what was going to happen to him.  When he is sitting there, he is more vulnerable to attack.
Objection… side bar.
She chose to stab him in the heart first.  She got the knife and we know that he felt it.  We know that he felt it because he reached up to grab the knife.  As he was seated there, he felt extreme emotional, mental anguish seeing that knife come at him.  He knows that the person doing it is the person he was just with.  Regardless of adrenalin, he hurts.
Jodi took one scratch to the wrist and stopped because it hurt too much.  She never stopped stabbing him.  Not only does it hurt when going in, it is followed by pain in the chest, like a heart attack.  He is still sitting there naked with her in a standing position.  For his efforts to defend himself, he gets more pain.  He can’t get away.  It’s extreme mental anguish.  This is a paper cut to the nth degree.
This is all a part of the beginning.  He can see his hands and chest bleeding in the small area with this woman who Ryan Burns says is strong.
He is finally able to get up and try to get away.  What is he thinking about?  His dog, his family, his grandmother, who received flowers from the defendant…
Objection… another trip to the bench
What is he thinking about, to see himself bleeding like that?  What is he thinking about as he tries to go to the sink area?  He can’t get her to leave him alone.  Somehow, the adrenalin takes the pain away!  He’s experiencing terror, he’s experiencing pain.
If he’s standing there, he’s alive.  He can see, he can here.  He can see his face in the mirror.  Was he screaming in pain, was he silent?  Common sense will tell you he wasn’t.  He’s not only seeing his own blood, and he sees himself and he sees the defendant stabbing him.  They can talk all they want about adrenalin, but he was in pain.  It was less than two minutes, but they must have been interminable to him.
Martinez then has everyone sit in silence for two minutes….  It does seem like forever…
And then he had his throat slit…
She gave him no choice… he was heading out the door, but he didn’t have the strength anymore.  He was seeing, he was hearing.  The last thing he saw was that defendant, with the blade coming toward him.
Martinez then read the law describing cruel and reiterates the entire series of events and the pain and suffering Travis was experiencing.
In addition, the defendant had to know he was suffering.  She was 27 years old.  She had received a cut somehow.  Should she have known he was suffering.  Any reasonable person of her age would know, should have known.  She knew HER throat was sensitive, she knew he was hurting.
Nurmi then gets up to do the closing for the defense.
He says it’s probably an untenable position for them (the jury) to realize they would have to decide if this was cruel.  We are seeing and hearing pain in this room, but they must be mindful of the jury instructions that they are not to be swayed by emotion, passion, etc.  Their decision must be detached and beyond a reasonable doubt.  He tells them to detach themselves from the emotion, the passion and make a decision.  It’s all about reasonable doubt.  If the alleged circumstance is not found, they must rule in favor of the defendant.
He reminds the jury that in the guilt part of the trial, all of this happened in 62 seconds and now they make it 2 minutes and make you sit through the two minutes to play on their sympathies and emotion.  Dr. Horn and Det. Flores had different versions of the offense.  Flores first said the shot came first.  If you believe the shot came first, he did not suffer.
DeMarte and Samuels talked about flight or fight.  Dr. Samuels and Dr. Geffner explained how adrenalin works.  Dr. Horn testified that adrenalin prevents the body from feeling pain.  The jury must be firmly convinced that adrenalin wasn’t kicking in and Mr. Alexander lost consciousness.
The other issue is the second factor the state must prove.  The defendant must know that the victim suffered.  Nurmi attacks Martinez’ discussion of the defendant’s “suicide” attack.  At first the prosecution didn’t believe it.  It was months, weeks after the event occurred.
She has to be conscious to the process going on.  He goes on about the fight or flight and now adds on to say that DeMarte said she had BPD.  He says that one characteristics of this is extreme violent outbursts.  Given that situation, the jury needs to give consideration to one of these episodes happening on June 4.  She was operating under the defect that Dr. DeMarte described.
Hmmm…. I’m surprised he didn’t say she was in her fog!
The jury shouldn’t react emotionally to the photographs, they are to detach themselves from that.  The State’s own experts explain the mental condition that meant that she was not aware of the pain she was inflicting.
Martinez speaks again.  It’s an ad hominem argument.
Objection… approach.
Nurmi had said the State is trying to fool you…  We are not talking about facts, we are talking about presentation.
Juan points out she knew enough to delete the photographs from the camera.  She decided to move the body away from the door, the smell…
If she did these things, she had to know what was going on…
License plate, clean up with water, etc.  Of course she knew what was going on.  Martinez then points out that these arguments from Nurmi that the jury has already dealt with those facts in the guilt phase of the trial.
He shows Exhibit 193 and other photographs of Travis.  The defense doesn’t want you to focus on these, but on events that have already been taken care of.  All they are dealing with is the issue of the pain and suffering of Travis Alexander.
We don’t know exactly what time was involved.  None of the pictures show the time when the first wound was inflicted or when the throat was slit.
Only death relieved the pain.
The judge then continued with the reading of the jury instructions.  The decision must be unanimous for or against.
The jury is sent out to deliberate and we are again left to wait…

I’ve spent the last couple of hours hanging around my computer waiting.  At 5:56 EDT, it was announced that a verdict had been reached after about 1 1/2 hours of deliberation.  This has been a terrible day for the family.  Every bit of Martinez’s’ case entailed graphic pictures left up on the screen for a long time as he questioned Dr. Horn.

Considering the defense put up some very weak arguments and had nary one witness, I was surprised it took the jury so long.  Then, I thought again; this is a thoughtful jury.  I’m sure that they gave aggravation meticulous attention.

Judge Stephens takes the bench at 6:06 EDT.  The procedure for reading the jury’s decision is the same as for any other verdict.

The jury found that the aggravating factor, ESPECIALLY CRUEL has been PROVEN!  The entire procedure took about 3 minutes.

Tomorrow morning, at 10:30 (3:30 EDT), the jury will return to decide the mitigating factors and decide on live or death.

Christian/Newsom Murders – George Thomas Retrial, Day 4

Day 3 testimony

I am still so miffed about losing all the testimony of ME, Dr. Mileusnic-Polchan.

From the testimony at previous trials:

WARNING, extremely disturbing!!!

Dr. Mileusnic-Polchan said Newsom’s body was face up, badly charred and a belt bound his feet. “The body was subjected to high heat.”  Newsom’s upper body was more burned. His ankles weren’t burned, but they were charred. In fact, Newsom’s body was so charred, he was almost unrecognizable.

Newsom was repeatedly raped with a foreign object just an hour or two before he was killed. She described the condition of Newsom’s anal area as having tears and lots of bruising.

“This is not just a rape,” she said. “This is the blunt trauma where an object comes in contact and severely damages the tissue. The depth of the injury was so grave there was no way that just the regular rape could inflict this.”

He was then blindfolded, gagged by a sock being shoved in his mouth, arms tied behind his back, his bare feet bound and his head covered.  He was either led or dragged to a set of railroad tracks. He was shot in the back of the head, the neck, and the back, and his body set on fire.

Dr. Mileusnic-Polchan said the gunshot to Newsom’s head caused “instantaneous death.”  There was also blunt trauma to his head, perhaps from hitting the ground after being shot.

Channon death came after hours of sexual torture.  Christian suffered horrific injuries to her vagina, anus, and mouth. Her top lip frenulum was torn.

She was not only raped, but also savaged with ‘an object’.

Dr. Mileusnic-Polchan said Christian had tears, bruising and swelling in her vaginal and anal areas, as well as signs of blunt force trauma.

She was not only brutally raped; she was then kicked repeatedly in the vaginal area. She also suffered blows to the head, bruising on her arms indicate she was grabbed by force and she had carpet burns on her back.  She also had hemorrhages on both sides of the top of her head.  They were severe, but not the cause of death.

Bleach was poured down her throat.  This was while Christian was alive. She was then bound in a fetal position with curtains and strips of bedding so tightly her knees were touching her cheeks.   Her face was covered with a small white trash bag and her body placed inside five black trash bags before being placed inside a large trashcan and covered with sheets. Christian died slowly by asphyxia with her eyes open.

Christian was wearing only a sweatshirt and camisole.

Day 4

All parties are in place.

Court begins at 9:05.

Both sides stipulate that the 4 Runner had a sunroof.

Leland Price enters a few more pieces of evidence.

State rests!

Jury sent out so the jury instructions can be finalized.

Johnson asks for an acquittal based on there is no evidence that Mr. Thomas committed any crime and that Ethel Freeman was mentioned during the case, but she was not called to testify.

Judge denies motion.

Thomas placed under oath and takes the stand.

Dillard asks if he knows he doesn’t have to testify, do you understand?  Yes.

You understand you have the right to testify if you so choose?  Yes.

Thomas waived the right to testify.

Defense will not offer any proof.

Jury brought back and the defense rests.

Jury again sent out so instructions can be finalized.

Two items are addressed, one was a typo and one was an instruction the defense didn’t want, but the judge overruled.

Both sides approved the verdict form.

Dillard tells Judge Kurtz he and Johnson will split the defense closing.

Judge agrees.

Court on a 10-minute recess and then the State will begin closing arguments.

Courts resumes at 9:34.

TaKisha tells the jury they asked what crimes were committed.

She discusses that fact the 4 Runner was stolen and at gunpoint.

The fact Channon was murdered.

Aggravated rape was proven.

Aggravated theft.

Premeditated murder because once Channon was bound and the plastic bag placed over her head and stuffed in the garbage bags and placed in the trashcan the intent was she would suffocate.

She details the crimes against Chris.

The State believes Thomas promoted and aided in the commission of the crimes.

Thomas was in the home before and after the crimes.

Thomas then fled to Kentucky.

Thomas’ own statement contains several versions.

Thomas says he woke up when the blindfolded kids were brought in and he looked out the sunroom and said nice ride.  Did he leave if he didn’t want to participate?  No he didn’t

His own statement indicates he knew crimes were being committed.  He even rode around in the 4 Runner.

Xavier Jenkins told you he saw 4 black males in the 4 Runner.

Thomas was in the house; he heard what was going on.

He fled to Kentucky and still stayed with Cobbins and Coleman.  Did he go to the Lebanon police and tell them about the crimes?  He had the opportunity to be the eyes and ears, but didn’t.

During questioning he could have helped investigators but he tried to save his buddies.

Johnson up…

The prosecutor just told you a story.  You didn’t hear any of that from the witnesses.

George Thomas is not guilty.

You get to decide about the government’s speculation and guesses.  That’s a powerful position.

The government pulled out all the stops on this case.

Johnson says Thomas had no criminal intent.

Thomas was not for them jacking the car, he told them to chill. The knowledge of the crime does not make him criminally responsible.  He has to act.

Yes he was at the house when they brought in Chris & Channon but mere presence doesn’t make him criminally responsible.

Thomas’ DNA was nowhere.

Johnson really hammering on Thomas’ statement to police.  The question is, did you believe it?

Johnson done.

Judge tells the jury they will next hear from Dillard, the State will finish up, and then they will hear the jury instructions

Judge calls a 10-minute break…

Tom Dillard is finishing the defense arguments.

He thanks the jury for their attention.

Says what was done to these kids was awful and they didn’t deserve this.

All the evidence shown in this case doesn’t take away the presumption of Thomas’ innocence.

Thomas didn’t encourage anyone in the crimes.

Just because they were friends doesn’t make Thomas responsible.

Stacy Lawson told you Thomas didn’t have a gun.  She even gave him money before she left.

Daphne Sutton went to the house to get her makeup.  Thomas was sitting at the TV; He didn’t say anything and didn’t try to stop her from going anywhere.

Now he’s dumping on Daphne for not calling the police.

There is no forensic evidence that ties Mr. Thomas to the horrible crimes were committed.

He’s discussing reasonable doubt & allowing the mind rest easily to the moral certainty of guilt.

We trust you to listen to the facts and we trust you will find Mr. Thomas not guilty.

Leland Price up.

He thanks the jury for their service.

No DNA, no fingerprints.  The state told you that.

Think about other items. The trash can. Any DNA on the trashcan? No, none was there.  Well, how did the can get there?  Did it fly to the spot in the kitchen?

You heard from the expert only 10% of the time, do we get fingerprints.

The Judge will give you instructions and will tell you, to determine criminally responsibility no act needs to be proven.

You heard Stacy Lawson tell you how small the house was and with no doors, you could hear everything gong on.

Price says to not check your common sense at the door.

Price says Thomas’ statement is self-serving garbage!

Davidson couldn’t have committed all these by himself, it took a ‘team’, and ‘G’ was part of the team.

Thomas went to Kentucky after murders. Do the innocent flee or do the guilty? Think about that.
